The Court’s decision in Case 4-24-CN/26 establishes that requiring individuals to be 18 years old to change their gender marker is unconstitutional when three conditions are met: the request is made by the teenager, supported by legal guardians, and backed by psychosocial reports demonstrating sufficient maturity to make informed decisions about gender identity.
“This ruling recognizes what we have known for years: gender identity develops during adolescence, and forcing young people to wait until adulthood causes real harm,” said Diane RodrÃguez, president of Asociación Silueta X, which has led legal advocacy on trans rights in Ecuador since 2009.
The decision cites the Court’s previous ruling in case 95-18-EP/24 involving a transgender girl in Salinas, creating what legal scholars call a “constitutional protection block” for transgender youth rights in Ecuador. The ruling has erga omnes effects, binding all state agencies including the Civil Registry to process such applications.
Ecuador now joins a growing number of countries recognizing that legal gender recognition should not be arbitrarily delayed until adulthood when professional assessments confirm an adolescent’s maturity. The ruling is particularly significant in Latin America, where several countries still maintain restrictive age requirements.
